Refund Policy
1. General Disclaimer
All services, previews, and campaigns created by Fountaine Films are custom creative productions. Due to the specialized nature of our work, refunds are limited and strictly governed by the terms outlined below. By engaging our services, clients acknowledge and agree to this policy in full.
2. Scope of Service
Fountaine Films commits to delivering cinematic campaigns, previews, and creative direction as described in signed agreements or confirmed invoices.
Timelines, deliverables, and creative scope will be clearly outlined before work begins.
Previews and demos are provided for evaluation only and remain the sole property of Fountaine Films until final payment and licensing.
3. Refund Eligibility
Refunds may only be considered if:
Fountaine Films fails to deliver the agreed-upon preview or campaign within the agreed timeframe (without prior communication of extension).
A client cancels within 48 hours of contract signing, before any creative work or resources are allocated.
4. Non-Refundable Costs
Because creative resources, software, and production time are invested immediately:
A non-refundable deposit of 35% of the total project cost is required at project start.
This deposit covers pre-production, strategy, and concept development, which cannot be recovered once initiated.
If cancellation occurs after delivery of any previews, edits, or drafts, 50% of the total project fee remains non-refundable.
5. Partial Refunds
If a project is terminated by mutual agreement after work has begun, Fountaine Films may, at its sole discretion, refund up to 50% of payments made, minus non-refundable deposit and costs incurred for completed work.
6. No Refunds Issued For
Dissatisfaction with creative style once work has begun, provided the deliverables align with the agreed creative brief.
Client delays, lack of communication, or failure to provide materials (logos, footage, brand guidelines) within agreed timelines.
Misuse or unauthorized posting of preview/demo materials.
Completed campaigns where deliverables have been provided.
7. Intellectual Property & Usage
All previews remain watermarked and cannot be used commercially until the full project is paid in full.
Unauthorized use of demo materials will result in legal action for damages.
Full usage rights transfer only upon final payment.
8. Governing Law
This policy is legally binding under the governing laws of the state of Texas, USA. Clients are encouraged to review and understand these terms before engaging services.
