1. Website Operator & Binding This website is owned and operated by Fountaine Films (Legal entity name here). By accessing or using our site or services, you agree to be bound by these Terms & Conditions.
2. Eligibility / Use of Site You must be at least 18 years old (or the legal age in your jurisdiction) and have the capacity to enter into a binding agreement.
3. Scope of Services We provide cinematic campaigns, previews, and creative services. Details (deliverables, timelines, scope) will be defined in a separate agreement or invoice.
4. Payments & Deposits A non-refundable deposit of 35% is required before any work begins. The remaining balance is due per the agreed schedule. Late or missing payments may suspend work or withhold deliverables.
5. Refund Policy Refunds only possible if:
We fail to deliver within the agreed timeframe (without prior notice), or
Cancellation is made within 48 hours of contract signing, before any work begins. Once work begins, at least 50% of the total project fee is non-refundable. Completed campaigns or delivered previews are not eligible for refunds.
6. Preview & Demo Policy All previews remain watermarked and are for evaluation only. They may not be used commercially without full payment. If shared publicly, watermark must remain visible and tag @FountaineFilms. Full rights transfer only upon final payment. Unauthorized use may lead to legal recourse.
7. Intellectual Property All creative assets, campaigns, and previews are owned by Fountaine Films until full payment is complete. Upon final payment, commercial usage rights transfer to the client. Unauthorized use, duplication, or modification is prohibited.
8. Client Responsibilities You must provide necessary assets (logos, brand guidelines, content) timely. Delays from your side are not grounds for refunds. You must review drafts and provide feedback per agreed timelines.
9. Warranties & Disclaimers Services are provided “as is.” No warranty is made that deliverables will meet every expectation. Any performance guarantees must be documented in writing. Satisfaction with creative style is subjective and not grounds for refunds if the work aligns with the agreed brief.
10. Limitation of Liability To the maximum extent permitted by law, Fountaine Films will not be liable for indirect, incidental, consequential damages, lost profits, or data loss. Our liability for direct damages is limited to the total amount paid for the project.
11. Indemnification You agree to indemnify and hold Fountaine Films harmless from claims, losses, or damages (including legal fees) arising from your use or misuse of our services or content you provide.
12. Termination & Suspension We may suspend or terminate your access or a project if you breach these Terms, misuse previews, or fail to pay. In such events, deposits and completed work remain non-refundable.
13. Modification of Services & Terms We reserve the right to change, suspend, or discontinue any feature, service, or aspect of the site or our offerings at any time without liability. We also may modify these Terms. Significant changes will be notified; continued use implies acceptance.
14. Promotional Communications / Emails By providing contact information, you consent to receive marketing emails from us. You may opt out at any time via an unsubscribe link or by contacting us.
15. Governing Law & Dispute Resolution These Terms are governed by the laws of Texas, USA. Any disputes must be brought in courts of Texas. Users waive class actions or jury trials as applicable.
